Presidency Defends Executive Order 9 as Constitutional Safeguard for Nigeria’s Revenue Management!

ABUJA , Nigeria The Presidency has reaffirmed that President Bola you Ahmed Tinubu’s Executive Order 9 is firmly rooted in constitutional provisions governing public finance and does not represent an overextension of executive power.
In an official clarification issued by a senior presidential aide, the administration stated that the directive is intended to strengthen compliance with Nigeria’s established fiscal regulations, particularly regarding the collection, remittance, and transparent management of public revenues by federal institutions.
According to the Presidency, the order reinforces accountability mechanisms within Ministries, Departments and Agencies (MDAs), ensuring that all revenues due to the Federal Government are properly declared and remitted in line with the 1999 Constitution (as amended), the Fiscal Responsibility Act, and other extant financial management laws.
Upholding Constitutional Mandates
Addressing criticisms suggesting that the directive may centralize fiscal authority within the executive arm, the aide maintained that Executive Order 9 does not create new constitutional powers but operationaylizes existing statutory obligations.
“The President is acting strictly within the framework of constitutional authority to guarantee that public funds are managed in accordance with the law,” the aide noted, emphasizing that the measure is targeted at blocking revenue leakages and improving financial discipline across government agencies.
Legal experts observe that executive orders in Nigeria function as administrative tools that guide the enforcement of existing laws. They do not supersede legislative statutes passed by the National Assembly but serve to clarify procedures and ensure uniform compliance across government institutions.
