Court Delays Hearing as Defence Counsel Fail to Appear in El-Rufai’s N1bn Suit Against ICPC!

Proceedings in the N1 billion fundamental rights enforcement suit filed by former Kaduna State governor, Nasir El-Rufai, were again stalled after lawyers representing the respondents failed to appear in court.

The suit, instituted against the Independent Corrupt Practices and Other Related Offences Commission (ICPC) and other security agencies, challenges the legality of a search conducted at El-Rufai’s residence. The former governor alleges that the operation violated his constitutional rights and is seeking N1 billion in damages.

At the resumed hearing, the absence of counsel representing the ICPC and other defendants forced the court to adjourn proceedings, prolonging a legal dispute that has drawn national attention due to its implications for due process and the limits of investigative authority.

El-Rufai’s legal team argued that the search of his home was carried out without proper legal authorization, describing the action as unconstitutional and an infringement on his right to privacy and dignity. The respondents, however, have previously indicated that their actions were within the bounds of the law and part of legitimate investigative activities.

Legal analysts note that repeated adjournments in high-profile cases such as this can delay justice and raise concerns about judicial efficiency, particularly in matters involving alleged rights violations by state agencies.

The case is expected to test the balance between anti-corruption enforcement and the protection of individual rights under Nigerian law. Observers say the outcome could set an important precedent for how investigative agencies conduct searches involving politically exposed persons.

The court subsequently adjourned the matter to a later date to allow the respondents’ legal representatives to appear and proceed with the case.
