APC Distances Party from Electoral Act, Says Law Reflects National Assembly Consensus Calls for Respect for Legislative Process!

Nigeria’s ruling party, the All Progressives Congress (APC), has clarified that the country’s Electoral Act was enacted through the constitutional legislative process led by the National Assembly, dismissing claims that the law was designed as a partisan instrument to favor the party.
Speaking amid renewed political debate over electoral reforms, APC spokesperson Felix Morka stated that the Electoral Act is not a creation of the ruling party but a product of deliberations by lawmakers representing diverse political interests across Nigeria. According to him, attributing the legislation solely to the APC undermines the institutional role of parliament and misrepresents how democratic laws are made.
Morka emphasized that the Electoral Act emerged from extensive consultations, committee reviews, and bipartisan contributions within the National Assembly before receiving presidential assent, in line with constitutional procedures. He urged opposition parties and political stakeholders to respect the legislative process rather than frame electoral laws as partisan tools.
“The Electoral Act is a law made by the National Assembly, not the APC,” the party spokesman said, stressing that lawmakers from multiple parties participated in shaping the provisions governing Nigeria’s electoral system.
Political Tensions Over Electoral Framework
The clarification comes as political actors intensify discussions around electoral transparency, election management, and proposed amendments ahead of future polls. Opposition figures have recently criticized aspects of the electoral framework, arguing that certain provisions require further reform to strengthen public confidence.
However, the APC maintains that democratic institutionsnot political parties are responsible for lawmaking. The party argued that disagreements over electoral outcomes or processes should be addressed through lawful channels, including legislative review and judicial interpretation.
Analysts note that Nigeria’s Electoral Act has remained central to political discourse since reforms introduced technological innovations such as electronic transmission of results and expanded regulatory powers for the Independent National Electoral Commission (INEC). While widely viewed as a step toward improving electoral credibility, implementation challenges and political disagreements continue to fuel debate.
Legislative Authority and Democratic Accountability
Constitutional experts highlight that under Nigeria’s governance structure, bills originate and are debated within the bicameral National Assembly before being signed into law by the president. As such, responsibility for the Electoral Act rests collectively with elected legislators rather than any single political organization.
The APC’s statement appears aimed at reinforcing institutional legitimacy while countering narratives that electoral laws are manipulated for partisan advantage. Observers say the exchange reflects broader tensions typical of competitive democracies, where electoral frameworks often become focal points of political contestation.
As Nigeria prepares for future electoral cycles, calls for dialogue, institutional trust, and adherence to democratic processes are expected to remain central to political engagement across party lines.
